1. Subscription Terms and Conditions
a) These Terms and Conditions relate to the PayDay News Newsletter and news Website: https://paydaynews.com.au/
b) PayDay News currently operates using the Beehiiv platform. The Terms of Use for their platform can be found here: https://www.beehiiv.com/tou
c) If you are entering into this agreement on behalf of a business or government entity, by accepting these terms you are warranting to PayDay News that you are authorised by the business or government entity to do so and to bind the business or government entity by your acceptance of these terms. In that case, “you” below refers to the business or government entity you represent (and any successor entity or assignee of a business).
d) If you proceed in signing up to PayDay News via subscribing you will be taken to have agreed with these rules and conditions, and this will form a legally binding contract between you and us upon which we can rely.
e) We may exclude any users from accessing the Website or cancel their subscription to the Newsletter if they are in breach of these terms.
f) These subscription terms are available on our Website and may be changed by us at any time. Such changes will be effective when amended terms are posted on our Website. We will try to provide you with timely notice of any material changes and may cancel your subscription within 30 days of any material changes if you do not agree to them.
2. Your Subscription
a) Your subscription gives you digital access to the Newsletter and Website you subscribed to, while your subscription is active. If there are different tiers of subscription for PayDay News, your subscription gives you access to the tier for which you subscribed.
b) You need to keep your username and password information to yourself. We are entitled to treat any use of the website by any person using your username and password as use by you or authorised by you for which you will be responsible.
c) Your subscription is for your personal use only. You are NOT permitted to share your log-in details with another person or use your subscription for any commercial purpose, including to share or on-sell your subscription to any third party. If you wish to obtain a multiple user subscription, you may qualify for a corporate subscription.
d) Subscription fees are not refundable except to the extent expressly set out in these terms.
e) We are not responsible and have no liability for any claim relating to payment, delivery or access to a Publication which resulted from you providing incorrect information to us. You need to report any such errors to us as soon as you become aware of them.
f) When you purchase your subscription, this is done via the Payments Platform provided by Beehiiv. Your subscription automatically renews for the next period at the end of each billing cycle and you will be charged unless you cancel before then.
g) Access to the Website and receipt of the Newsletter is for subscribers only. Only paid subscribers have access to paid content.
h) Under no circumstances must any of the material available on the website or in any newsletter be resupplied or made available to any other person by any means for any commercial purpose without the express permission in writing being obtained from us in respect of the proposed use.
3. Liability
We cannot and do not guarantee that:
a) the Newsletter will be delivered by a particular time on any day
b) your access to the Newsletter and/or the Website will be uninterrupted or secure
c) information found in the Website and/or in the Newsletter will be 100% reliable, current, accurate or complete
d) the Website and its server platform (beehiiv) are free of viruses or bugs
e) To the extent permitted by law we exclude all liability in connection with access to or use of the Website or the Newsletter and any information found in them.
In no event will PayDay News be liable to you or any third party for any indirect, consequential or incidental damages, including (without limiting and, to the extent necessary, expanding, the meaning of those terms) lost profits, loss of or damage to goodwill, or loss of any form of expected benefit, arising from your use of the Newsletter or the Website, your reliance on any information found on the Newsletter or on the Website or any technical failures, delays in operation or transmission or malfunctions in equipment or software.
4. Pricing
We can change our pricing and fees at any time. We will give you at least 14 days notice if the new price is greater than the price you are currently paying. If you would prefer to cancel your subscription, you may do so before the end of the billing cycle.
5. Cancellation
You can cancel your subscription via your account on the Website and through the Newsletter unsubscribe section. We do not make partial refunds for any subscription types if you choose to cancel your subscription early.
6. Copyright
We own or we have licensed all copyright and other intellectual property in the content and design of the Newsletter and the Website.
7. Third party content
a) The Newsletter and the Website contain links to other websites that are not our responsibility.
b) We have no control over the content of the linked websites and we are not responsible for the content of those websites.
c) Inclusion of any linked website in the Newsletter or on the Website does not imply approval or endorsement of the linked website by PayDay News.
8. Privacy
a) You agree that certain personal information (which may include your name, email address, postcode and mobile/telephone number) may be collected and stored by us and used to, amongst other things, manage your subscription, communicate with you about your subscription and to notify you of any associated customer offers or benefits, future subscriptions and/or other goods and services that we consider you may be interested in, unless you opt out of these communications.
